These Terms of Use (“Terms”) govern your access to and use of this website, storefront, product pages, documentation, support materials, downloads, and other information or services made available by The Earth Shack Software LLC (collectively, the “Site”).
These Terms also apply to your use of information made available through the Site about our digital software products, applications, dashboards, command tools, and related materials (collectively, the “Software” or “Products”). Your installation, copying, downloading, or use of any Software is also governed by the applicable License Agreement / End User License Agreement (“EULA”).
By accessing or using this Site, purchasing a Product, downloading a file, or using any related materials, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase, download, install, or use our Products.
1. Who we are
This Site is operated by The Earth Shack Software LLC (“we,” “us,” or “our”). We develop local-first digital software tools for technically minded users, including situational awareness dashboards, personal command tools, portfolio-awareness utilities, display surfaces, and related software products.
Current Earth Shack Software Products include Sentinel, Guardian, and Vestrus. Product names, availability, features, requirements, and supported use cases are described on the applicable product pages.
Use of the Software itself is governed by the applicable EULA, which is provided with the Software, displayed in the Software where applicable, and/or made available on this Site. The EULA is incorporated into these Terms by reference.
2. Use of the Site
You may use this Site solely for lawful purposes, including:
- Learning about Earth Shack Software Products;
- Reviewing product descriptions, documentation, FAQs, release notes, policies, and support materials;
- Purchasing, downloading, or accessing Products where available;
- Contacting us for support, questions, or business matters.
You agree not to:
- Use the Site in any way that violates applicable laws, regulations, or third-party rights;
- Attempt to gain unauthorized access to the Site or any related systems, accounts, networks, or infrastructure;
- Probe, scan, test, bypass, or circumvent any security, access-control, authentication, rate-limiting, or technical protection measures;
- Use bots, scrapers, crawlers, automated tools, or bulk-access methods in a way that imposes an unreasonable load on the Site or extracts substantial content without permission;
- Copy, reproduce, frame, mirror, republish, or reuse substantial portions of the Site’s content for competitive, commercial, or misleading purposes without our written permission;
- Misrepresent your identity, affiliation, authorization, or relationship with us;
- Upload, transmit, or submit malicious code, unlawful content, infringing material, or information intended to interfere with the Site or other users.
3. Product information and availability
Product descriptions, screenshots, feature lists, documentation, examples, compatibility notes, and availability statements are provided for informational purposes. We try to keep product information accurate and current, but Products may change over time as they are updated, corrected, revised, or withdrawn.
A reference to a Product, feature, version, or capability on the Site does not guarantee continued availability for purchase, download, update, or support. Current availability and applicable product details are stated on the relevant product page or other official Earth Shack Software materials.
Unless expressly stated otherwise, product purchases provide only the rights described in the applicable EULA and product page. No purchase grants ownership of the Software itself, resale rights, redistribution rights, hosting rights, sublicensing rights, or rights to source code.
4. Relationship to the License Agreement / EULA
Your use of any Earth Shack Software Product is subject to the applicable EULA. The EULA may address, among other things:
- Who may use the Software;
- How many computers, users, or installations are allowed;
- Backup-copy rights;
- Restrictions on redistribution, sharing, resale, hosting, sublicensing, modification, reverse engineering, or public posting;
- Product-specific notices, disclaimers, and limitations;
- License termination conditions.
If there is a conflict between these Terms and the applicable EULA regarding your use of the Software, the EULA controls for Software use. These Terms govern your use of the Site, storefront, documentation, product pages, support materials, and related online materials.
5. Purchases, digital downloads, and refunds
Purchases may be processed through third-party e-commerce, payment, delivery, or digital-download providers, including platforms such as Shopify or other service providers. Your transaction may be subject to these Terms, the applicable EULA, our posted policies, and the terms and policies of the third-party provider.
You are responsible for:
- Providing accurate checkout, contact, and payment information;
- Confirming that the Product fits your intended use before purchase;
- Reviewing product descriptions, system requirements, compatibility notes, FAQs, and support materials before purchase;
- Downloading, storing, and backing up your purchased files, license materials, and user data;
- Maintaining a compatible device, browser, operating system, network connection, and working environment;
- Using the Software only as allowed by the applicable EULA.
Unless expressly stated otherwise, sales of digital downloads are considered final once the product is delivered or downloaded. Refunds, replacements, or download assistance may be considered only as described in our Refund Policy.
If a refund is approved, your license to use the refunded Software may terminate, and you may be required to delete all copies of the Software and related license materials in your possession or control.
6. Local-first software, browser storage, and backups
Many Earth Shack Software Products are local-first tools. They may run as self-contained files in a modern browser and may store settings, preferences, user data, portfolio information, task information, configuration data, or other local records in the user’s browser storage, downloaded files, exported backups, or local device environment.
You are responsible for maintaining your own backups, exports, passwords, browser profiles, devices, operating systems, and local files. Clearing browser storage, changing browsers, moving files, replacing computers, using private/incognito modes, or changing security settings may affect whether local data remains available.
We are not responsible for data loss caused by user action, browser behavior, device failure, operating-system changes, local storage limits, extension conflicts, malware, backup failure, or other circumstances outside our control.
7. No emergency, safety-critical, financial, legal, or professional reliance
The Site and Products are provided for informational, visualization, organizational, awareness, and personal productivity purposes only. They are not designed, certified, or intended for safety-critical, emergency, operational, medical, legal, financial-advice, investment-advice, aviation, navigation, evacuation, or life-safety use.
Do not rely on the Site or Products for:
- Emergency management, evacuation, shelter, or life-safety decisions;
- Official warnings, alerts, or notifications;
- Trading, investment, tax, legal, medical, or professional decisions;
- Navigation, aviation, maritime, industrial, infrastructure, or mission-critical operations;
- Any use where inaccurate, delayed, unavailable, or incomplete information could cause harm, financial loss, property damage, injury, or legal consequences.
Products that display weather, hazard, geospatial, orbital, radio, market, portfolio, calendar, task, or other information may be delayed, incomplete, inaccurate, unavailable, or affected by third-party source changes, network conditions, browser behavior, local configuration, data-entry errors, or software limitations.
Always rely on official agencies, qualified professionals, primary records, brokerage statements, tax documents, emergency managers, and authoritative sources when making safety, financial, legal, operational, or other consequential decisions.
We are not affiliated with, endorsed by, or acting on behalf of any government agency, emergency agency, exchange, brokerage, financial institution, data provider, or third-party service unless expressly stated in writing.
8. Third-party data, services, APIs, and links
Earth Shack Software Products may display, retrieve, link to, calculate from, summarize, or visualize third-party information, including public datasets, weather data, geospatial data, seismic data, orbital elements, space-weather data, market data, news, calendar information, API responses, or other external sources.
Third-party data and services are controlled by their respective providers. We do not control, guarantee, or assume responsibility for:
- The accuracy, completeness, reliability, timeliness, or availability of third-party data;
- Changes to third-party APIs, formats, terms, rate limits, access rules, licenses, or availability;
- Outages, delays, interruptions, or incorrect results from third-party sources;
- Content, policies, security, or practices of third-party websites or services.
Any use of third-party websites, services, data, or APIs is at your own risk and may be subject to the third party’s own terms, licenses, privacy policies, and usage restrictions.

9. Intellectual property
Unless otherwise noted, the Site, Product names, product designs, user interfaces, text, graphics, logos, screenshots, documentation, downloads, code, visual presentation, and other materials are owned by The Earth Shack Software LLC or used under license, and are protected by copyright, trademark, trade dress, and other intellectual-property laws.
You may not, except as expressly allowed by the applicable EULA or written permission from us:
- Copy, reproduce, modify, adapt, translate, distribute, sell, rent, lease, sublicense, host, publish, repost, share, or create derivative works from the Site or Products;
- Remove, alter, or obscure copyright, license, attribution, trademark, or proprietary notices;
- Use our names, logos, product names, screenshots, or branding in a way that implies endorsement, sponsorship, partnership, resale authorization, or affiliation;
- Use the Site or Products to create, market, or support a competing product or service in violation of applicable rights or license terms.
Third-party materials, datasets, libraries, APIs, trademarks, and content remain the property of their respective owners and may be governed by separate licenses or terms.
10. Copyright complaints and takedown requests
If you believe material on the Site or in our Products infringes your copyright, please review our DMCA and Takedown Policy for information about submitting a notice.
We may remove or disable access to material, links, references, downloads, or other content when we believe it may infringe rights, violate applicable law, violate our policies, or create legal or operational risk.
11. User communications and submissions
If you send us comments, suggestions, bug reports, feature ideas, screenshots, files, support requests, or other submissions, you grant us permission to use that information as reasonably necessary to provide support, improve Products, investigate issues, develop updates, respond to you, and operate our business.
Please do not send confidential, proprietary, sensitive, regulated, or third-party information unless we have specifically requested it and you have the right to provide it. You are responsible for ensuring that anything you submit to us does not violate the rights of others or applicable law.
Submitting feedback does not create any obligation for us to compensate you, implement the suggestion, maintain confidentiality, or treat the submission as proprietary unless we have a separate written agreement stating otherwise.
12. Privacy
Our handling of information collected through the Site is described in our Privacy Policy, if posted. Local-first Products may store user data locally on your own computer or browser rather than transmitting it to us. Product-specific documentation may describe local storage, export, backup, or data-handling behavior.
Third-party services used for checkout, payment processing, email, downloads, analytics, hosting, or support may collect and process information under their own terms and privacy policies.
13. Disclaimers
The Site, Products, downloads, documentation, support materials, data, visualizations, examples, and all related content are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
- Warranties of accuracy, completeness, timeliness, reliability, availability, security, or error-free operation;
- Warranties of merchantability, fitness for a particular purpose, title, and non-infringement;
- Warranties that the Site or Products will meet your requirements or operate uninterrupted, securely, or without errors;
- Warranties that defects will be corrected or that downloads, files, data, or third-party services will remain available.
You are solely responsible for how you interpret, configure, rely on, export, back up, or use any information obtained from the Site or Products.
14. Limitation of liability
To the fullest extent permitted by law:
- We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, use, business opportunity, investment value, portfolio value, or other intangible loss arising out of or related to the Site, Products, downloads, data, third-party services, or these Terms.
- We will not be liable for losses resulting from third-party data errors, outages, source changes, API limits, user configuration, user data entry, browser storage behavior, local file handling, failure to maintain backups, or unsupported environments.
- Our total cumulative liability for any claim arising out of or relating to these Terms, the Site, or any Product shall not exceed the greater of the amount you paid directly to us for the Product giving rise to the claim during the twelve months before the claim arose, or one hundred U.S. dollars (USD $100).
Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you in full.
15. Indemnity
To the extent permitted by law, you agree to indemnify, defend, and hold harmless The Earth Shack Software LLC and its owners, officers, employees, contractors, agents, affiliates, successors, and assigns from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your use or misuse of the Site or Products;
- Your violation of these Terms or the applicable EULA;
- Your violation of any law, regulation, or third-party right;
- Your submissions, communications, files, data, or content provided to us;
- Your reliance on any content, data, visualization, output, or third-party information displayed by or accessed through the Site or Products.
16. Changes to the Site, Products, and Terms
We may update, modify, suspend, discontinue, rename, repackage, correct, or withdraw any part of the Site or any Product at any time, with or without notice, subject to any rights expressly provided in the applicable EULA or purchase terms.
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the Site, purchase of Products, or use of related materials after changes are posted constitutes acceptance of the updated Terms.
17. Governing law and venue
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, USA, without regard to conflict-of-law principles.
The venue for any disputes arising out of or relating to these Terms, the Site, or related online materials shall be the state or federal courts located in North Carolina, USA, unless applicable law requires otherwise.
