Privacy policy

Last updated: July 2026

The Earth Shack Software LLC (“we,” “our,” or “us”) operates this website, storefront, product pages, documentation, downloads, and related services in order to provide information about and access to Earth Shack Software products (collectively, the “Services”). Our storefront is powered by Shopify, which helps provide the Services, process orders, and support the shopping experience.

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our website, use our storefront, make a purchase or other transaction, download a product, contact us for support, or otherwise communicate with us.

This Privacy Policy applies to the website and storefront. Some Earth Shack Software products are local-first applications that run on your own computer or in your own browser. Those products may store settings, configuration, portfolio information, task information, weather/location preferences, or other user data locally on your device or in your browser storage. Except where a product feature, third-party service, checkout process, support request, or user action sends information elsewhere, local application data generally remains under your control on your own device.

If there is a conflict between this Privacy Policy and our Terms of Use regarding the collection, processing, or disclosure of personal information, this Privacy Policy controls for privacy matters.

Please read this Privacy Policy carefully. By using or accessing the Services, you acknowledge that you have read and understand this Privacy Policy.

1. Personal Information We Collect or Process

“Personal information” means information that identifies, relates to, describes, or can reasonably be linked to you or another person. Personal information does not include information that has been anonymized or de-identified so that it cannot reasonably be linked to you.

Depending on how you interact with the Services, where you live, and what features or third-party services are used, we may collect or process the following categories of personal information:

  • Contact details, such as your name, email address, billing address, shipping address, phone number, and other contact information you provide.
  • Transaction information, such as products viewed, cart activity, purchases, downloads, order history, refunds, cancellations, exchanges, and related transaction records.
  • Payment information, such as payment method details, payment confirmation, transaction status, and payment-processing information handled by Shopify and payment processors. We do not directly store full payment-card numbers.
  • Account information, if accounts are enabled, such as username, password, preferences, settings, and account activity.
  • Communications with us, including information you provide in support requests, contact forms, emails, bug reports, refund requests, DMCA notices, feedback, or other messages.
  • Device and usage information, such as browser type, device type, operating system, IP address, network information, pages viewed, referring pages, approximate location derived from network information, and interaction with the website or storefront.
  • Download and fulfillment information, such as order status, download availability, product fulfillment status, and related delivery records.

2. Local-First Product Data

Many Earth Shack Software products are designed to be local-first. Depending on the product, the application may store user data in your browser, on your computer, or in files you export or import. This may include settings, dashboard preferences, product configuration, location preferences, task data, portfolio information, watchlists, notes, manual entries, backups, or other product-specific data.

Local-first product data is generally controlled by you and stored on your own device or in your own browser profile. We do not receive that local application data unless:

  • You choose to send it to us for support;
  • You email, upload, or otherwise provide a backup, screenshot, log, diagnostic report, or other file;
  • A product feature intentionally uses a third-party API, feed, website, browser feature, or external service;
  • A checkout, download, update, support, or license-related process requires information to be processed by us, Shopify, or another service provider.

You are responsible for maintaining your own exports, backups, browser profiles, local files, and device security. Clearing browser storage, using private/incognito mode, changing browsers, moving files, replacing computers, or changing security settings may affect whether local product data remains available.

3. Sources of Personal Information

We may collect personal information from the following sources:

  • Directly from you, including when you visit the Services, make a purchase, create an account, contact us, request support, submit a form, or otherwise provide information.
  • Automatically through the Services, including from your device, browser, cookies, pixels, logs, and similar technologies used by Shopify or other service providers.
  • From service providers, including Shopify, payment processors, download/fulfillment providers, email providers, hosting providers, support tools, analytics tools, fraud-prevention services, and other vendors who help operate the Services.
  • From partners or third parties, where permitted by law and consistent with their own privacy notices and terms.

4. How We Use Personal Information

We may use personal information for the following purposes:

  • Providing the Services, including operating the website and storefront, processing orders, delivering downloads, maintaining accounts, providing purchase confirmations, handling refunds, and managing customer support.
  • Product support and troubleshooting, including responding to support requests, reviewing product issues, diagnosing download or compatibility problems, and communicating with you about your order or product.
  • Storefront improvement, including understanding how users interact with the website, product pages, documentation, checkout, and support materials.
  • Marketing and communications, including sending product updates, promotional messages, announcements, or other communications where permitted by law and subject to your communication preferences.
  • Security and fraud prevention, including detecting, investigating, and responding to fraudulent, unauthorized, abusive, unsafe, or unlawful activity.
  • Legal and compliance purposes, including complying with law, responding to legal process, enforcing our Terms of Use, EULA, refund policy, DMCA policy, or other policies, and protecting our rights or the rights of others.

5. How We Disclose Personal Information

We may disclose personal information to third parties for legitimate business, operational, legal, or compliance purposes, including:

  • Shopify, which hosts and powers the storefront and processes information as part of providing the shopping experience.
  • Payment processors and financial service providers that process payments, refunds, fraud checks, and transaction records.
  • Service providers and vendors that help us operate the Services, such as hosting, IT, email, customer support, digital-download fulfillment, analytics, security, fraud prevention, storage, and related services.
  • Business and marketing partners, where permitted by law, to provide marketing, advertising, or promotional services.
  • Legal, regulatory, or safety recipients, when needed to comply with applicable law, respond to legal process, enforce our policies, protect our rights, investigate fraud or abuse, or protect the rights, property, or safety of users or others.
  • Business transaction parties, in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction.

We do not sell downloadable product files or local product data to advertisers. Where privacy laws define “sale,” “sharing,” or “targeted advertising” broadly, certain Shopify, advertising, analytics, or marketing activities may be treated as a sale or sharing under those laws. You may have rights to opt out as described below.

6. Relationship with Shopify

7. Cookies and Similar Technologies

The Services may use cookies, pixels, local storage, logs, and similar technologies to operate the storefront, remember preferences, process shopping carts, support checkout, detect fraud, understand usage, and provide or measure marketing and advertising where applicable.

Your browser may allow you to block, delete, or manage cookies. Some storefront features, checkout functions, account functions, or embedded services may not work properly if cookies or similar technologies are disabled.

Local-first Earth Shack Software products may also use browser storage for product settings or user data. Product browser storage is different from storefront cookies and may be necessary for local product operation.

8. Third-Party Websites, Services, and Links

The Services and Products may link to, retrieve data from, display information from, or interact with third-party websites, APIs, public data sources, payment services, download providers, documentation sources, or other external platforms.

We do not control third-party websites or services and are not responsible for their privacy, security, accuracy, availability, or practices. Your use of third-party services is subject to their own terms and privacy policies.

9. Children’s Privacy

The Services are not intended for children, and we do not knowingly collect personal information from children under the age of majority in their jurisdiction. If you are a parent or guardian and believe a child has provided us with personal information, please contact us so we can review and delete the information where appropriate.

We do not have actual knowledge that we sell or share personal information of individuals under 16 years of age as those terms may be defined under applicable privacy laws.

10. Security and Retention

We use reasonable administrative, technical, and organizational measures intended to protect personal information. However, no website, storefront, browser, device, network, transmission, or storage system can be guaranteed to be perfectly secure.

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, process transactions, maintain records, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, and operate our business.

Local-first product data stored on your device or in your browser remains your responsibility. We cannot recover local product data that is deleted, overwritten, lost, or never provided to us.

11. Your Rights and Choices

Depending on where you live, you may have some or all of the following rights regarding your personal information. These rights are not absolute and may apply only in certain circumstances:

  • Right to access / know personal information we maintain about you.
  • Right to delete certain personal information.
  • Right to correct inaccurate personal information.
  • Right to portability, where applicable.
  • Right to opt out of certain sale, sharing, targeted advertising, or marketing uses where applicable.

You may exercise available rights by contacting us using the contact information below or by using any privacy tools made available through Shopify or the storefront.

If you visit the website with the Global Privacy Control opt-out preference signal enabled, Shopify and/or the storefront may treat that signal as a request to opt out where required by applicable law. Other “Do Not Track” signals may not be recognized.

You may opt out of promotional emails by using the unsubscribe link included in those emails. Even if you opt out of promotional communications, we may still send non-promotional messages related to orders, downloads, support, account activity, policy changes, or other transactional matters.
