These Terms of Use (“Terms”) govern your access to and use of this website (the “Site”) and any information, content, or services made available through it, including information about our software product EarthView (the “Software”).

By accessing or using this Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Who we are

This Site is operated by The Earth Shack Software LLC (“we”, “us”, or “our”). EarthView is a browser-based software application we provide for visualizing seismic activity, volcano locations, tectonic plate boundaries, satellite position and visibility, local weather context, and related geospatial and orbital information.

EarthView may be purchased and downloaded through third-party platforms such as Shopify. Your use of the Software itself is governed by a separate License Agreement / End User License Agreement (EULA), which is provided with the Software and available on this Site, and is incorporated here by reference.

2. Use of the Site

You may use this Site solely for:

  • Learning about EarthView and related products;
  • Reviewing documentation, FAQs, and support materials;
  • Purchasing or downloading Earth View;
  • Contacting us for support or questions.

You agree not to:

  • Use the Site in any way that violates applicable laws or regulations;
  • Attempt to gain unauthorized access to the Site or any related systems or networks;
  • Probe, scan, or test the vulnerability of the Site or circumvent any security or authentication measures;
  • Use automated systems (such as bots or scrapers) that impose unreasonable load on our infrastructure;
  • Copy, reproduce, or reuse substantial portions of the Site’s content for any competitive or commercial purpose without our written permission.

3. No emergency or safety-critical use

EarthView and this Site are for informational and visualization purposes only. They are not designed or intended for:

  • Emergency management;
  • Life safety, evacuation, or shelter decisions;
  • Official warning, alert, or notification purposes.

EarthView visualizes public data (for example, earthquake and volcano feeds, weather and alert data, and orbital elements for satellites and stations). These visualizations may be delayed, incomplete, or incorrect due to upstream source delays, network conditions, format changes, or computation limits. They are:

  • Not official warnings or alerting systems;
  • Not a substitute for government or scientific agency guidance;
  • Not guaranteed accurate, complete, or up to date.

Always rely on official sources (such as national and local government agencies and emergency managers) for real-world safety and evacuation decisions.

We are not affiliated with, endorsed by, or acting on behalf of any government or emergency agency.

4. Relationship to the License Agreement (EULA)

Your use of EarthView is subject to a separate License Agreement / EULA that, among other things:

  • Defines how you may install and use the Software (for example, as a single-user license for one natural person);
  • Sets licensing terms and conditions;
  • Describes restrictions on redistribution, sharing, hosting, and modification.

If there is any conflict between these Terms and the License Agreement with respect to your use of the Software, the License Agreement controls.

These Terms govern your use of this Site and any content we publish here.

5. Purchases and digital downloads

Sales of EarthView may be processed by third-party e-commerce providers (such as Shopify).

When you purchase EarthView:

  • The transaction is subject to both these Terms and the terms and policies of the e-commerce provider (for example, Shopify’s terms of service, payment processing terms, and refund policies).

You are responsible for:

  • Providing accurate contact and payment information;
  • Downloading and securely storing your copy of the Software and license file;
  • Maintaining any device and browser required to run the Software;
  • Ensuring your use of the Software complies with the License Agreement (for example, not sharing or redistributing the Software to other users).

Unless explicitly stated otherwise, all sales of digital downloads are considered final. We may, at our sole discretion, consider refunds or replacements in limited circumstances (for example, if you cannot access the download due to a technical issue). 6. Intellectual property

Unless otherwise noted:

  • The Site, including its design, text, graphics, logos, images, and other content, is the intellectual property of The Earth Shack Software LLC.
  • EarthView, including its code, design, and visual presentation, is owned by The Earth Shack Software LLC and protected by applicable copyright and other intellectual property laws.

You may not:

  • Copy, reproduce, modify, or create derivative works based on the Site or EarthView for any commercial or competitive purpose, except as expressly allowed by the License Agreement;
  • Use our names, logos, or branding in a way that implies endorsement or partnership without our written permission.

7. Third-party data and links

EarthView may display data from third-party sources such as:

  • The United States Geological Survey (USGS);
  • Public geographic datasets (for example, Natural Earth, tectonic plate datasets);
  • Orbital element and tracking data providers (for example, CelesTrak);
  • Weather and alert providers (for example, MET Norway, U.S. National Weather Service).

This Site may also link to third-party websites, APIs, or resources. We do not control, and are not responsible for:

  • The accuracy, completeness, or availability of third-party data;
  • Any changes or outages of third-party services;
  • Content on third-party websites.

Any use of third-party data or websites is at your own risk and subject to the third parties’ terms and policies.

We do not claim endorsement by, or affiliation with, any third-party data provider or agency.

8. Disclaimers

The Site and all content made available through it are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • Warranties of accuracy, completeness, or reliability of any content or data;
  • Warranties of merchantability or fitness for a particular purpose;
  • Warranties that the Site will be uninterrupted, error-free, or secure.

We do not warrant or guarantee:

  • The accuracy or timeliness of seismic, weather, satellite/orbital, or other geophysical data;
  • That any visualization or indicator produced by Earth View reflects real-time conditions or official warnings.

You are solely responsible for how you interpret or use any information obtained from the Site or the Software.

9. Limitation of liability

To the fullest extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or related to:
    • Your use of or inability to use the Site; or
    • Your reliance on any content, data, or visualization displayed by the Site or the Software.
  • Our total cumulative liability for any claim arising out of or related to these Terms or your use of the Site shall not exceed the greater of:
    • The amount you paid directly to us for access to EarthView (if any), or
    • One hundred U.S. dollars (USD $100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you in full.

10. Indemnity

To the extent permitted by law, you agree to indemnify, defend, and hold harmless The Earth Shack Software LLC and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

  • Your use of the Site;
  • Your violation of these Terms;
  • Your misuse of any content, data, or visualizations provided through the Site or the Software.

11. Changes to the Site and Terms

We may update or modify the Site, or these Terms, at any time. When we do, we will update the “Last updated” date at the top of this page.

By continuing to use the Site after changes are posted, you agree to the revised Terms. If you do not agree with the changes, you should stop using the Site.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, USA, without regard to its conflict of law principles.

The venue for any disputes arising out of or relating to these Terms or the Site shall be the state or federal courts located in the State of North Carolina, USA, unless applicable law requires otherwise.
